These Terms of Service (the “Terms”) are a legally binding agreement between LLC «Hosting in Ukraine» (the “Company”, the “Contractor”) and any individual or legal entity (the “User”, the “Customer”) who registers on hosting.in.ua, uses the Client Area (account.hosting.in.ua) or orders the Company's services.
1. General provisions and relation to the Offer
1.1. The Company provides shared hosting, VPS/VDS and dedicated server rental, domain registration, SSL certificates, system administration and related services.
1.2. These Terms apply together with and supplement the Public Agreement (Offer). Registering on the website or paying any invoice means full agreement with these Terms.
1.3. The Company may change these Terms unilaterally. Changes take effect from the moment they are published on this page.
2. Registration, account and personal data
2.1. To receive the services, the User must provide only true, up-to-date and accurate contact, identification and legal information.
2.2. The User is solely responsible for keeping their login and password confidential and for any actions performed using their account.
2.3. By registering, the User consents to the processing of their personal data in accordance with the Law of Ukraine “On Personal Data Protection” and the Company's Privacy Policy for accounting, billing and technical support purposes.
3. Pricing, payment and currency conversion
3.1. Services are provided on a 100% prepayment basis unless otherwise stated in a separate Specification. Invoices are generated automatically in the Client Area.
3.2. If the base price of a service or plan is set in a foreign currency (euro), it is automatically converted and invoiced in the national currency (hryvnia) at the official NBU exchange rate on the invoice date plus 10% (ten percent) to cover interbank fees and exchange rate risks.
3.3. In case of late payment, the Company may suspend the services. Dedicated servers and custom configurations have strict data retention periods set out in the relevant Service Specification, after which the data is irreversibly destroyed and the hardware is reclaimed.
3.4. The Company is not a VAT payer. All payments are final. Refunds are made only within the scope and on the terms of the [Refund Policy], except for dedicated server rental, setup fees and domain/license registration, which are non-refundable.
4. Acceptable Use Policy
4.1. It is strictly prohibited to use the Company's resources for:
- Sending spam (including bulk mailings without the recipients' consent), phishing, hosting malware (viruses, trojans, cryptocurrency miners);
- Hosting and distributing child pornography, calls for violence or the overthrow of the constitutional order, racism, war propaganda and other content prohibited by the laws of Ukraine;
- Organizing and carrying out DDoS attacks, network scanning, brute-force attacks or any actions that threaten the stability of the Company's infrastructure or the Internet.
4.2. Abuse policy: upon receiving an official complaint from rights holders (copyright infringement), law enforcement, the Cyber Police or CERT-UA, the Company reserves the right to temporarily block access to the service or the shared port for 24 hours to investigate. If the User does not provide a reasoned response or does not remove the violation, the services are terminated without refunding the remaining balance.
4.3. The User must follow the Fair Use Policy. The load must not cause abnormal interference for other users of the system.
5. Limitation of liability and force majeure
5.1. All services and infrastructure are provided “as is”. The Company does everything possible to ensure uninterrupted operation but does not guarantee the complete absence of technical failures.
5.2. The Company is not liable for loss of the User's data, lost profits, indirect or consequential losses or interruptions to the User's business. The User is responsible for creating and storing backups of their data on third-party platforms.
5.3. The Company's maximum aggregate financial liability for any claims may not exceed the amount actually paid by the User for the last 1 (one) month of the relevant service.
5.4. The Parties are released from liability for failure to fulfil or improper fulfilment of their obligations in the event of force majeure, including military actions, acts of terrorism and prolonged emergency power outages (blackouts). Since the Contractor's key technical staff and/or ultimate beneficial owner are engaged in state and military duties defending Ukraine (including military service), if they are in areas without communication or without physical access to civilian infrastructure, the Contractor may unilaterally change the timing of physical repairs, component replacement or maintenance of the Equipment at the data center for the duration of such circumstances, without any penalties, fines or obligation to compensate losses.
